Terms & Conditions

1. Definitions

  • Service: PodPeak™ pod-matching and related digital assets.
  • Provider: PublishPeak Media, operator of PodPeak™.
  • User: Anyone accessing or purchasing the Service.
  • Materials: Calendar templates, guides, reports, and analytics dashboards.

2. Acceptance

By accessing or paying for the Service, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, do not proceed.

3. Service Scope & Delivery

  • The Service is a one-time, non-recurring pod match. No subscription or ongoing commitment.
  • Delivery includes digital Materials upon payment clearance.
  • Provider does not guarantee specific performance metrics, except pod composition criteria.

4. Eligibility & User Responsibilities

  • Users must meet eligibility requirements: 5K+ engaged followers, weekly engagement, content standards.
  • Users commit to abide by the Rules & Commitments page at all times.
  • Provider may audit or suspend accounts for non-compliance without refund.

5. Payment & Fees

  • All fees are due in full at checkout via approved payment methods.
  • Prices exclude taxes; User is responsible for applicable sales or VAT.

6. Refund & Cancellation

We stand by our vetting process, but understand there can be genuine mismatches. If you are later determined ineligible, you will receive a refund of your full pod fee minus a $5 vetting service fee to cover screening costs. No other refunds are issued once digital Materials or match data have been delivered or accessed.

Pro Tip: Review eligibility criteria thoroughly before purchase to avoid vetting fees.

7. Intellectual Property

  • All Materials are licensed, not sold. User may use them for their own campaigns but may not redistribute.
  • User grants Provider a perpetual, royalty-free license to aggregate anonymized data for service improvement.

8. Limitation of Liability

To the maximum extent permitted by law, Provider's liability is limited to the amount paid by User. Provider disclaims all indirect, incidental, and consequential damages.

9. Indemnification

User agrees to defend, indemnify, and hold harmless Provider from any claims arising out of User's breach of these Terms or violation of third-party rights.

10. Termination

Provider may terminate or suspend access immediately for breaches. Upon termination, any unpaid fees become due.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of Calgary, Canada. Disputes will be resolved through binding arbitration in Calgary, under the rules of the AAA.

Privacy Policy

1. Data Collection

  • Account Data: name, email, social handles, billing info.
  • Engagement Metrics: follower counts, likes, comments.
  • Usage Data: IP address, device, cookies, session logs.

2. Use of Data

  • To provide and improve the Service, including pod matching.
  • To communicate updates, offers, and support.
  • To conduct analytics and share aggregated insights internally.

3. Data Sharing & Disclosure

  • We do not sell or trade Personal Data.
  • We may share with service providers bound by confidentiality (e.g., hosting, payment processors).
  • We disclose data if required by law enforcement or to protect legal rights.

4. Cookies & Tracking

We use essential cookies for functionality and optional cookies for analytics. You can manage consent via your browser settings.

5. Data Retention

We retain Personal Data for as long as necessary for service provision, legal compliance, and dispute resolution, typically up to 3 years after last activity.

6. Security Measures

We implement encryption, secure servers, and access controls. However, no system is entirely foolproof.

7. Your Rights

  • Deletion: Request erasure, subject to legal retention rules.
  • Portability: Request a copy of your data in a machine-readable format.
  • Objection: Opt-out of marketing or profiling at any time.

8. Third-Party Links

9. Children’s Privacy

We do not knowingly collect data from minors under 18. If discovered, we will delete such data upon request.
